New SC Bench to hear Golden Key depositors’ FR case on March 4

The Supreme Court on March 4 will name a new Bench to hear the fundamental rights (FR) cases of the depositors of the Golden Key Finance credit card company.
When the case was mentioned on Monday (18), Supreme Court Judge Nimal Gamini Amaratunga J withdrew from hearing the FR cases filed by the Golden Key depositors.
The case was taken up before a Bench comprising Justices Nimal Gamini Amaratunga, K. Sripavan and S.I. Imam. Justice Amaratunga addressing the parties, informed them he would not participate in the hearing, and accordingly, put off the case for March 4, to nominate a new Bench. However, he did not render any reasons for his refusal.
On the last occasion, when the case was heard by a Bench comprising Justices Nimal Gamini Amaratunga, K. Sripavan and presided over by former Chief Justice Dr Shirani Bandaranayake, Dr. Bandaranayake withdrew from hearing all cases filed by the depositors of the Ceylinco Shriram Capital Management and Golden Key credit card company – the two companies mentioned in the impeachment motion against her.
Depositors of the Golden Key credit card company, aspetitioners of several FR cases filed in 2009, cited 17 respondents including the Monetary Board of the Central Bank, the Governor of the Central Bank, the Secretary to the Treasury, Golden Key credit card company, Lalith Kotelawela, Khavan Perera, Sicille Kotelawela, the Ceylinco Consolidated and the Attorney General.
The petitioners complained that the respondent company first stopped payment of interest on deposits, and then forestalled withdrawal of their deposits, without giving any reasons.
