Script writer sues Saudi Prince for failure to produce film

A petition filed in the Commercial High Court by a producer and script writer against a Saudi Arabian Prince for failure to produce a film based on the script writer’s story, was postponed till June 18. The petitioner M.Z.M. Rafik in his application cited Royal Highness Prince Ai Waleed, Rotana Audio Visual and Rotana Holding Company as respondents.

The petitioner stated that he had written a script titled ‘The Diamond Merchant’ and was keen to produce a film based on it for the international market. He said that the 1st defendant is a highly rated person in the production of international films and artistic ventures. The petitioner stated that when the 1st defendant visited Sri Lanka he had the opportunity of meeting him and forwarded the script to him for his consideration. The 1st defendant had then requested the petitioner to develop the story line further and said he would produce the film through the 2nd and 3rd defendant companies of which he is the owner.

Further the petitioner stated that after all the trouble taken and the expenses he had incurred the defendants refused to proceed with the production without any rhyme or reason. The petitioner is claiming a sum of US $ 400,000 as compensation.

The case was taken up in the Colombo High Court where the defendants had made preliminary objections against the petitioner. This case was dismissed. The defendants then filed special leave to appeal in the Supreme Court and this too was dismissed without costs. The case is now being heard at the Commercial High Court and was postponed to June 18.
