Patient claims Rs 10m+ damages from Oasis Hospital for negligence

A patient claiming damages from The Oasis Hospital, for serious injuries she sustained at the hospital premises, due to the negligence of the hospital authorities, when she visited the hospital for treatment, was heard before Judge Priyantha Fernando at the Colombo District Court this week.

The patient, Winifred Aileen Perera, visited The Oasis Hospital on December 26, 2012, for treatment for pain in her right shoulder. She said that, after her consultation with the doctor, while leaving the hospital premises, she lost her footing over a manhole which had been loosely covered with a rug and fell. She was immediately taken for X-rays by Dr S. Sathkunanayaden.

The X-rays revealed multiple fractures to the knee, and she was advised to undergo immediate surgery, free of charge.However, the doctors present refused to operate at the hospital due to the substandard surgical facilities available. The Surgeon Dr S.D. Karunarathne was willing to operate only at Asiri hospital
The plaintiff said that the act of negligence by the hospital authorities, had caused severe pain and partial disability of the use of her leg.

Mrs. Perera claimed damages of Rs 10 million plus Rs. 226,524.66 for the operation at Asiri Hospital.Attorney-at-Law Avindra Rodrigo along with Attorneys-at-Law Sanuri Semini and Mahela Liyanage appeared for the plaintiff, while Attorney-at-Law Padma Bandara appeared for the defendant, Oasis Hospital.
