Letter to Peiris copied to CJ 43, adding she could resume her duties

The process for the removal of Mohan Peiris from the post of Chief Justice was set in motion on Wednesday after the President’s Secretary P.B.Abeykoon dispatched a letterto Mr. Peiris informing him that his appointment had no legal validity and had been void from the day he was appointed to the Bench.

The letter from the President’s Secretary said that Shirani Bandaranayake’s removal from the post of Chief Justice on January 11, 2013 was carried out unconstitutionally and the appointment of Mohan Peiris, PC as the Chief Justice was illegal from the very outset.

A copy of this letter was dispatched to Ms. Shirani Bandaranayake along with another letter which said the President wishes to inform her that she can resume her duties at the Chief Justice. Copies of both letters were also sent to the Supreme Court Registrar M. Maheshi Jayasekera.

A ceremonial sitting of the Supreme Court was held on Thursday to bid farewell to Chief Justice Bandaranayake who retired from her post several hours after resuming her duties.

Following this, President Sirisena appointed K. Sripavan, the most senior judge on the Supreme Court Bench to the post of Chief Justice.
