Writ application fixed for support on Dec.6

The Court of Appeal this week fixed Dec.6 for support of the writ application filed by W.S. Nandimal Silva, seeking an investigation into the alleged killing of 27 inmates of Welikada Prison in December 2012.

The Bench comprised Justices L.T.B. Dehideniya (President) and K.K. Wickramasinghe.

When the case was taken up on Tuesday (17), the Attorney General (AG) assured the investigation would be conducted in a transparent manner, after which a progress report will be submitted.

Senior State Counsel Madhava Tennekoon, appearing for the AG, informed Court there were inquiries conducted by teams from the Special Task Force, Army and Prison officers.

Counsel for the petitioner, K.S. Ratnavale urged, the investigation should be conducted in a transparent manner and its progress conveyed to Court.

In his writ application, petitioner claimed he was an eyewitness to the incidents which occurred on Nov.9-10, 2012. He was remanded at Welikada at the time of the incident, on charges under the Prevention of Terrorism Act (PTA). He was later released in 2013, without charges being framed .

He cited the Commissioner General of Prisons, Director CID, IGP, Minister of Prison Reforms, Rehabilitation, Resettlement and Hindu Religious Affairs and the AG as respondents.
