Basil and Nadesan acquitted after contractor disputed signature
View(s):Former Finance Minister Basil Rajapaksa and his relative and businessman Thirukumar Nadesan were acquitted by the Gampaha High Court on Friday in the Malwana property case.
The Attorney General had filed three indictments against them for misappropriating state funds by purchasing a 16-acre property in Malwana and constructing a luxury house equipped with a swimming pool and a farm.
When the case was taken up on March 25 this year, first witness Upul Kumara Ramawickrama, the contractor who built the house, told court he had not lodged a complaint with the Police Financial Crimes Investigation Division and the signature on the statement could not be accepted.
The Attorney General’s Department told court that since the witness made such a statement, no further evidence would be examined in the case.
Lawyers appearing for the accused had thereafter requested court to release their clients. As the prosecution had not been able to prove its case beyond reasonable doubt, Gampaha High Court Judge Nimal Ranaweera acquitted the accused from all charges.
