Court
of Appeal in crisis over President's nominee
President Chandrika Kumaratunga has nominated Additional Solicitor
General Saleem Marsoof as the President of the Court of Appeal despite
protests from other judges. Mr. Marsoof's nomination has been sent
to the Constitutional Council for confirmation.
The
vacancy arose after Court of Appeal President Nimal Dissanayake
was elevated to the Supreme Court afterthe retirement of Justice
P. Edusuriya.
Some
of the Court of Appeal judges have protested that Mr. Marsoof lacks
experience for the post and he is not among the specified categories
of persons who could be appointed.
Persons
holding the post of Attorney General, Solicitor General, Legal Draftsman
and Secretary to Ministry of Justice could be appointed to the post.
However a legal jurist also could be appointed.
The
Sunday Times learns that the appointment of Mr. Marsoof would mean
a bypassing of the senior most Court of Appeal judge Gamini Amaratunga.
The Constitutional Council will be meeting on March 10. |
