Fraudulent land transfer case on Nov. 1

The trial of the former Sri Lanka Bar Association Secretary Bandula Wijesinghe and military spokesman Colonel Sumedha Perera who have been indicted for fraudulently claiming the ancestral home owned by the philanthropist who was the first Kotte Mayor, will commence on November 1.

High Court Judge Rohini Perera this week set November 1, 2 and 3 as trial dates after the Attorney General's Department informed courts that investigations had been completed and they were indicted.

Accordingly indictments were served on Colonel Perera, Mr. Wijesinghe and the caretaker of the property Sarath Wijewardena. The house situated on a one and a half acre block of land formerly owned the late Donald Obeysekara has been declared by the Archaelogical Department as a protected property in 1992.

Mr. Wijesinghe has been charged for preparing a forged deed of gift, on or around June 11, 2001, for the land located in Rajagiriya. Colonel Perera and Wijewardena has been indicted for aiding and abetting the first accused. According to the complaint, Colonel Sumedha Perera, along with the caretaker had claimed ownership to the property after producing the forged deed of gift.

The Court ordered that the fingerprints of the three suspects be taken. Anuja Premaratne, appearing for Colonel Perera and Mr. Wijewardena , asked that the trial date be brought forward because the complainant himself had arrived from the UK. It was the counsel's opinion that the presence of the complainant, Mr. Stanley Obeysekera at the trial would be in the interest of justice. Mr. Obeysekere was present at the hearing.

Court thereafter issued summons on the prosecution witnesses and fixed the trial dates. State Counsel Navaratne Marasinghe appeared for the prosecution. Earlier the Attorney General's Department had called for a second report from the Examiner of Questioned Documents regarding the signatures on the document.

Investigations had revealed that the former owner of the land had been in hospital on the day the documents were produced. He had passed away a few days later.
