Failed
doctor given leave to proceed
The Court of Appeal has given the petitioner, Dr. Shiranthi Perera,
leave to proceed with the case and extended the interim order placed
restraining the Post Graduate Institute of Medicine from releasing
the Ophthalmology Final Examination pass list.
The
case will next be heard on March 2005 and the examination results
withheld until March 14 with the Colombo University and PGIM prevented
from ratifying the provisional results.
Dr.
Shiranthi Perera has named 72 respondents, including the PGIM, the
Board of Study of Ophthalmology and the Senate of the University
of Colombo. Citing several instances of irregularities in the conducting
of the exam, she seeks either the holding of fresh exams or a uniform
policy for ophthalmology examinations. Among the irregularities
Dr. Perera mentioned was that she was failed the exam even though
she obtained higher marks than the set pass mark of 72.
The
examiners had stated that she failed one section but Dr. Perera
had stated that in the previous year those who failed that section
were accorded passes if they had obtained the necessary overall
marks. One of the respondents, an examiner, has mentioned in her
affidavit that certain examiners were apparently trying to favour
some candidates during the clinical exam. She had earlier written
to the PGIM in this regard. |
