killing: Suspect files FR petition

A fundamental rights petition has been filed in the Supreme Court
on behalf of a suspect in the assassination of former Foreign Minister
Lakshman Kadirgamar.
The petitioner Sivarasan Sivarajan cited Director, Colombo Crimes
Division Sarath Lugoda, Colombo Crimes Division Inspector Nuwan
Wedasingha, former Defence Secretary Maj. Gen. Asoka Jayawardena
and IGP Chandra Fernando as respondents.
Sivarajan
who operates a business under the name of 7-11 provides mobile phone
connections, SIM cards, transport services, air and sea parcel distribution
services and travel and tour services. He said his distribution
of SIM cards extends to many places in the island including the
North and East and that there are people who purchase SIM cards
from him and supply other clients.
He
claimed he was informed by Colombo Crime Division officers to call
over at their office for questioning on September 24, 2005 and when
he went there he was arrested and detained as a SIM card sold by
him was found with one Thiruchelvam who was a suspect arrested in
connection with the assassination.
Sivarajan
said Thiruchelvam was a regular customer and purchased SIM cards
from him.Saliya Peiris with S. Bandara instructed by Gowri Sangari
Thavarasa appeared for the petitioner and said the detainee was
not informed of the reason for his arrest. No receipt was issued
to the detainee for his detention and he had no connection with
the assassination and therefore his detention was arbitrary and
unreasonable.He claims his fundamental rights had been violated
and he should be released.The Bench comprised Justices Dr. Shiranee
Bandaranayake, T.B. Weerasuriya and Rajah Fernando. |
