22A: BASL seeks changes in process of appointment, composition of Constitutional Council
View(s):The 22nd Amendment to the Constitution Bill will not meet the aspirations of the people unless the process of appointment to and the composition of the Constitutional Council are changed, the Bar Association of Sri Lanka (BASL) said this week.
If the country wants to bring about political and economic changes, the relevant authorities have to make changes to the current draft, BASL President Saliya Peris told a news conference.
“According to the Constitutional Council’s composition, seven members of Parliament and three other non-members of parliament have been proposed as members of that constitutional council.” The three non-members of parliament should be appointed by Parliament with the majority’s consent. When parliamentary majority approval is considered, a problem regarding the independence of these three appointed to this council may arise,” he said.
Mr. Peris believes that the party with the majority in the Parliament has the ability to control the composition of the proposed Constitutional Council.
The council is supposed to play a clear role in appointing high positions.
If the CC is not independent, a problem also arises regarding the independence of the appointments made by that Council. One of the main reasons for the economic crisis in this country is the lack of independence and weakness of institutions, Mr. Peiris said.
The BASL Executive Committee observed that the 22nd Amendment does not create sufficient checks and balances on the incumbent President’s exercise of powers under the current Parliament, because most of the provisions in the amendment that seek to limit the President’s powers will become operative only after the dissolution of the current Parliament.
