CPC to be amended to speed up accident compensation cases

The Civil Procedure Code is to be amended to avert inordinate delays in victims of accident cases obtaining damages for their injuries.
The amendments will allow for the medical examiner’s report to be used as evidence at a trial before the court without the need to submit any further proof, the Justice Ministry’s Additional Secretary, Piyumanthi Peiris, said.
In terms of the amendments, in cases pertaining to claiming damages for injury to a person, the court will make an order that the injured person submit himself to an examination by medical practitioners nominated by the court.
Parties to the case are entitled to have one or more medical practitioners of their choice present at such an examination as observers. This report can then be submitted to the court.
The proposed amendments will curtail the long delay in calling medical officers to court to give evidence despite their busy schedules. It will also pave the way for victims or their heirs to receive damages within a short period, said the Additional Secretary.
