SC rulings on AJP, SJB party expulsions
View(s):Parliamentarian Ven Athuraliye Rathana Thera will keep his parliamentary seat after the Supreme Court (SC) ruled that the decision by Ape Janabala Party (AJP) to expel him from party membership was not valid in law.
The Disciplinary Committee of AJP had sent a letter to Ven Rathana Thera on October 15, 2021 informing him of its decision to expel him. Sanjeeva Jayawardena, PC, who appeared for the petitioner, argued that according to the memorandum of understanding (MoU) between the Vijaya Dharani Jathika Sabawa headed by his client and the AJP, the latter’s Disciplinary Committee had no power to take disciplinary action against him.
Taking the argument into consideration, with Justices Janak De Silva and Murdhu Fernando agreeing, Justice Buwaneka Aluvihare in his judgment ruled that the decision by AJP to expel the petitioner was not valid in law.
Meanwhile, further hearing into the fundamental rights petitions requesting an order nullifying the decision by the Samagi Jana Balawegaya (SJB) to expel Ministers Manusha Nanayakkara and Harin Fernando was postponed by the SC to October 24.
