Killing of MP and police guard: AG appeals against bail order
View(s):By Ranjith Padmasiri
The Attorney General has appealed to the Supreme Court (SC) to cancel the bail granted by the High Court Trial-at-Bar to 41 accused in the murder case of former Parliamentarian Amarakeerthi Atukorala and his police bodyguard on May 9, 2022, during one of the worst days of public protests.
The AG has argued that releasing the accused on bail will be an impediment to the conduct of a fair trial. He has asked that the SC cancel the bail order given by the High Court and has requested that the accused be placed in remand custody till the conclusion of the trial.
The AG’s petition has cited all 41 as respondents and is due to be taken up before a five-judge SC bench headed by Justice Preethi Padman Surasena on February 12.
Meanwhile, the trial into the murders of the former MP and his bodyguard is due to be taken up again on January 11 at the Gampaha High Court Trial-at-Bar headed by High Court Judge Sahan Mapa Bandara and comprising Judges Rashmi Singappuli and A.D. Ruwan Pathirana.
The Trial-at-Bar recently inspected the Nittambuwa site where the murders were committed. A report on the inspection visit, along with a plan detailing the layout of the location, is due to be submitted to the Trial-at-Bar by the registrar of the Gampaha High Court. The report and the plan had been compiled on the orders of the court.
The case will resume on January 11, with evidence being given by Chief Inspector A.D. Collure, who was the first officer to arrive at the scene of the crime on the day of the murders on May 9, 2022. The evidence will be led by Deputy Solicitor General Janaka Prasanna Bandara.
