AG files objection to Hirunika’s bail plea

The Attorney General has filed objections in the Colombo High Court against the bail application filed by former MP Hirunika Premachandra requesting court to release her on bail pending an appeal into her three-year prison sentence.
In his objections, the AG points out that the accused “is no longer presumed to be innocent” as she was found guilty after a trial by a competent court and thus the Petitioner has to demonstrate “exceptional circumstances” as required by the Bail Act to be granted bail pending her appeal.
The AG has stressed in his objections that the decision of granting bail pending the appeal must in each case depend on its own peculiar facts and circumstances. He added that the facts that the accused is a social activist, has no previous convictions and had duly attended court proceedings are not exceptional grounds to consider the granting of bail pending the appeal as she has been sentenced to three years rigorous imprisonment after having considered the gravity of the offences committed, especially as a Parliamentarian.
