Court rejects visa extension request for X-Press Pearl Captain

The Colombo High Court has rejected a request to order an extension of the visa of Tyutkalo Vitaly, the Russian Captain of stricken container vessel X-Press Pearl.
High Court Judge Sujeewa Nissanka rejected the request considering that the Supreme Court has already issued an interim order suspending further proceedings of the case following a request made on behalf of the accused, including the Russian captain.
Lawyers for the accused had filed a motion in high court requesting the court to issue an order on the Controller General of Immigration and Emigration to extend the Russian captain’s visa so that he could continue staying in the country.
Senior Deputy Solicitor General Madawa Tennakoon, appearing for the Attorney General, told court that since the Supreme Court has already suspended high court proceedings into the case, the court currently had no power to make any decision regarding this matter.
Lawyers for the accused argued that what the Supreme Court had stayed was the hearing of evidence. Mr Tennakoon though, argued that the court had stayed the entire case. In the end, lawyers for the accused also accepted this to be the argument, leading to the judge stating that he could not give an order regarding the matter.
The court also rejected a request made by Indra Hettiarachchi, one of the accused, that he be allowed to travel abroad for medical treatment.
