Legal cases filed over parliamentary election

Several fundamental rights petitions in relation to the 2024 parliamentary election have been filed before the Supreme Court (SC). Following are some of the developments on these court cases.

The SC dismissed four of the five fundamental rights petitions challenging the decisions by district Returning Officers to reject nominations submitted for the election.

The Bench comprising Justices Preethi Padman Surasena, Achala Wengappuli and Priyantha Fernando ordered the Election Commission (EC) to accept the nominations submitted by the Democratic National Alliance for the Vanni District that was earlier rejected by the district Returning Officer.

However, petitions filed by the Democratic National Voice over the rejection of its nominations for the Kegalle District, the Sinhala Deepa Jathika Peramuna over the rejection of its nominations for the Puttalam and Badulla Districts as well as the one filed by YouTuber Ashen Senarathna over the rejection of nominations submitted by his independent group for the Colombo District, were dismissed by the SC.

Meanwhile, a petition was also filed in the SC challenging the nomination of former MP Ranjan Ramanayake, who is contesting the election from the Gampaha District under the United Democratic Voice. The petition was filed by K M Mahinda Senanayake, who is contesting the election in the Gampaha District from an independent group.

Mr Senanayake’s petition argues that Mr Ramanayake is disqualified by law from sitting as an MP or voting. As such, he has asked the SC to reject his nomination.

In another development, the petition filed requesting the SC to rule the decision to hold the parliamentary election on November 14 as unconstitutional will be considered by the Court on November 4. When the petition was taken up before SC Justice Arjuna Obeyesekere, the Court ordered the respondents to file any objections they had regarding the petition on October 28.

The petition has been filed by Priyantha Herath, a civil society activist and convener of the “Api Lanka” Organisation. The SC ordered the petitioner to file counter objections before November 1.
