The Supreme Court’s verdict regarding four fundamental rights petitions requesting an order cancelling Paper I of the recently held Grade 5 scholarship exam and ordering the Commissioner General of Examinations to re-conduct the examination will be delivered on December 31.

The SC concluded its hearing into the case after the Criminal Investigation Department (CID) submitted a comprehensive report into its probe regarding the leaking of questions in the examination paper within 24 hours as directed by court.

The SC also obtained a report on the case currently being heard into the incident at the Kaduwela Magistrate’s Court.

The petitions were heard before a bench comprising Justices Yasantha Kodagoda, Kumuduni Wickremasinghe and Arjuna Obeysekere. Solicitor General Viraj Dayaratne, who appeared for the respondents, informed court that the government has decided not to re-conduct the examination.

At the onset of the hearing the SC issued an order preventing the awarding of full marks to the three questions that are confirmed to have leaked. The court further halted the issuing of cut-off marks for admitting students to national schools based on the exam. The petitioners, comprising several students and their parents, have also sought Rs 10 million in damages.

Saliya Pieris, PC and
