Supreme Court rejects AG’s request for a Full Bench

A request by the Attorney General to hear the petition filed by the Captain of stricken container vessel MV X-Press Pearl and the directors of the ship’s local agent before a full bench has been rejected by the Supreme Court.

The petitioners had petitioned the Supreme Court requesting an order dismissing the case filed against them in the Colombo High Court. Deputy Solicitor General Madhawa Tennakoon requested the SC through a motion on behalf of the AG to hear the case before a full bench.

DSG Tennakoon requested the bench, comprising Chief Justice Murdu Fernando along with Justices Dilip Nawaz and Achala Wengappuli, to appoint a full bench to hear the petition since it contains many important matters related to the case.

However, Romesh De Silva, PC and Sarath Jayamanna, PC, who appeared for the petitioner, strongly objected to the request, arguing that there was no legal basis for the request. After considering the matter, the court ultimately accepted the argument made by counsel for the respondents and rejected the AG’s request.
