Doctor suspended for posing as consultant radiologist loses appeal

The Court of Appeal has ruled in favour of the Sri Lanka Medical Council (SLMC) and its Professional Conduct Committee’s (PCC) move to impose a suspension on a medical practitioner found to have posed as a consultant radiologist without possessing the necessary qualifications to do so.
The medical practitioner filed a writ petition in the Court of Appeal against the PCC’s decision to impose a one-year suspension on him, reduced to six months, after an inquiry found that he had issued medical certificates without having full qualifications to be a consultant radiologist or without obtaining the board certificate to function as a consultant radiologist from the Post-Graduate Institute of Medicine. He used a rubber stamp to introduce himself as a consultant radiologist and acted as a consultant radiologist and had a private channelling practice.
With Justice Mayadunne Corea agreeing, Justice S. U. B. Karalliyadde, in his determination, observed that the PCC was fully empowered to take action against the petitioner.
The court further noted that even though the petitioner claimed that he pleaded guilty to get the inquiry expedited, the petitioner himself had admitted to committing such misconduct by mistake. The PCC initially imposed a one-year suspension, and thereafter, considering the submissions made in mitigation on behalf of the petitioner, reduced the sentence to six months. “Considering the above facts, this Court is of the view that the PCC has granted a sentence to the petitioner exercising the power vested with them in terms of Section 25(1) of the Medical Ordinance,” the Court ruled, dismissing the petitioner’s application.
