Sri Lanka has facilitated the implementation of the reciprocal recognition, registration, and enforcement of judgements from 53 Commonwealth countries, including the United Kingdom, Australia, India and Canada, from this week.
Accordingly, a gazette notification has been issued by Justice Minister Harshana Nanayakkara that the effective day for the implementation of the Act was March 26.
Sri Lanka passed the Reciprocal Recognition, Registration and Enforcement of Foreign Judgements Act in 2024.
The Act aims to facilitate the reciprocal recognition, registration, and enforcement of judgements from other countries’ courts.
The Act repealed previous related ordinances which have been operational for several decades.
The Act was introduced following a Court of Appeal judgement seeking an order on the implementation of a divorce order given in a foreign country.
A senior Justice Ministry official said that initially the Commonwealth countries have been covered, and more countries will be added after taking into consideration their laws.
Among the other countries covered by the Gazette notification issued this week are Bangladesh, Pakistan, Maldives, Cyprus, Kenya, Malaysia, South Africa, Singapore and Zimbabwe.
