Accused faints on hearing sentence

There was a stir in the Kandy High Court when an accused fainted on sentence being passed on him by Kandy High Court Judge Preethi Padman Surasena. The accused, W. M.Chamal Karunaratne, was sentenced to five years rigorous imprisonment and fined Rs. 25,000, to be paid to the mother of the victim Abdul Munaz (32), a vendor.

Six others were also accused of being involved in the murder of the vendor in Colombo Street (now W.A.B.Soyza Mawatha) in Kandy. Each of them was sentenced to six months rigorous imprisonment suspended for five years with compensation of Rs. 25,000 from each of them to be paid to the victim’s mother.

The six others were Rizan, Dilshan, Chamal, Sumith, Nilantha and S. Mohamed, all of Mahaiyawa in Kandy. The incident had occurred on September 18, 2003.The victim was a vendor who was killed in a fight which broke out suddenly.

Wijaya Wickramaratne PC pleaded in mitigation that the accused had committed the offence without any intention to murder the victim. He sought from Court a lenient sentence.

Wijaya Wickramaratne PC, with Attorney Nimal Suraweera, Ms. Dhammika Ariyadasa, Ms. Geevani Herathge appeared for the accused and Attorney-at-Law Piyasiri Abeykoon appeared for the seventh accused with Attorney-at-Law S Wijekoon (Assigned). State Counsel Ms. Prabodhani Munasinghe prosecuted.
