Duminda
remanded
Western Provincial Councillor Duminda Silva suspected of raping
an underage girl and abducting her father was on Friday remanded
till August 23 when the case came up for hearing before Colombo's
Chief Magistrate.
Mr.
Silva's lawyer Nalin Ladduwahetty told Chief Magistrate Sarojini
Kusala Weerawardane his client had been acquitted by the Kaduwela
Magistrate Court on the same charge six months ago.
Although
the Magistrate noted that the Kaduwela acquittal was not relevant
to this case, Mr. Laduwahetty persisted in saying this was a bailable
offence. The defence said the complaint made to the National Child
Protection Authority (NCPA) was completely false and the girl's
parents were aware his client was having an affair with their eldest
daughter.
Mr.
Ladduwahetty said in his submission that a complaint made on November
29, 2002 by Roger de Silva the girl's father that the politician
had kidnapped his elder daughter was proved to be false.
However
the Magistrate observed the girl's parents had no reason to make
a malicious complaint since it would endanger their daughter's reputation.
Citing the threats received by the complainant's family the Magistrate
refused bail to Duminda Silva who was evading arrest for most of
the week before turning up it court on Friday.
The
Magistrate instructed the Immigration and Emigration Chief not to
permit the suspect from leaving the country. Considering the submissions
made by the National Child Protection Authority, the Magistrate
noted that several death threats had been issued against the girl
and the family and directed the Police to provide maximum security
to the victim.
Police
Investigation is being carried out by Bambalapitiya Inspector Ananda
Kumarasiri under the guidance of Colombo DIG Sirisena Herath. Nalin
Ladduwahetty with U.L.G. Bandara, Namal Perera, U.M.P.M. Madumalee
and Mahee Wijeweera appeared for the suspect. |
