Land
fraud case not going to another court
The withdrawal of the petition filed by the aggrieved party in the
Fredrick Obeysekera land fraud case, seeking to transfer the case
from the High Court to another court was allowed by the Court of
Appeal.
In
this case former Military Spokesman Sumedha Perera and former caretaker
Sarath Wijewardena are indicted for claiming the land and property
of Mr. Obeysekera by producing false documents.
Faiz Mustapha, counsel for the accused previously insisted on costs
and amendment of the wording in the withdrawal motion, reserving
the right to come before the court if the need arose in the future.
Dr. Ranjith Fernando, counsel for the aggrieved party agreed to
proceed to a full inquiry if these conditions were insisted on.
Mr Mustapha told court he will not insist on these conditions.
Deputy Solicitor General Y. Kodagoda said he will not stand in the
way as the Attorney General did not oppose the application for transfer
of the case, as they feel that in any event the High Court Judge
will take the necessary steps to transfer the case after all that
had transpired.
Dr.
Ranjith Fernando agreed to withdraw the application for a transfer
as he was convinced that at the end of the day justice will be seen
to be done.
