The case filed against three persons over the Welikada prison riots has been fixed for October 14 by the Special High Court.
During today's hearing, court ordered the case to proceed without serving indictments on prisons intelligence officer Indika Sampath who has been named as the accused in the case.
An arrest warrant has been issued on the accused who is believed to have evaded arrest and travelled overseas.
Previously, indictments had been handed over to Police Inspector Neomal Rangajeewa and former Prisons Superintendent Emil Ranjan Lamahewa over the case.
The judge bench ordered the four witnesses in the case during the next hearing.
The Attorney General had filed indictments against the accused on July over their alleged involvement in the 2010 Welikada Prison riots which had resulted in the death of 27 inmates.
