concerned over resignation of JSC members
The President of the Bar Association of Sri Lanka, Desmond Fernando,
PC yesterday expressed concern about the resignation of Justice
Dr. Shirani Bandaranayake and Justice T.B. Weerasuriya as members
of the Judicial Services Commission.
The
resignation of Justice Dr. Bandaranayake and Justice Weerasuriya
will leave the JSC paralysed as the vacancy cannot be filled immediately
due to the non-functioning of the Constitutional Council which can
make appointments to the JSC.
“The
Bar Association of Sri Lanka is most appalled and gravely disturbed
at the causes which led to the sudden and abrupt decision on the
part of two senior Supreme Court judges, namely, Justice Dr. Shirani
Bandaranayake and Justice T.B. Weerasurirya to resign from the JSC”,
a statement from Mr. Fernando said.
“We
understand that the resignations were not due to any personal reasons,
but due to the simmering state of discontent prevailing for some
time within the JSC...’ , he said.
He
said that the Independent JSC has been constitutionally entrenched
to safeguard and protest the independence of the judiciary. “We
of the Bar have witnessed with disgust, pain of mind and a deep
sense of anguish the rapid and continuing erosion of the values
of justice and fair play in the country. To us, the latest development
represents the final blow to all the concepts that we hold dear
in the Administration of Justice”, Mr. Fernando noted.
Dr.
Bandaranayake is the most senior judge and Justice Weerasuriya is
the most senior career judge in the SC. “These two judges
are highly respected by the legal profession for their personal
honour, impartiality, integrity, fairness and ability. It is thus
a matter of great regret that they have resigned”, Mr. Fernando
said.
