AG instructs CID, Acting IGP to arrest eight persons over Avant Garde case

The Attorney General (AG) has instructed the Acting Police Chief to arrest eight persons including Avante Garde Chairman Nishshanka Senadhipathi over the case concerning the illegal floating armoury.

In a letter addressed to Acting IGP C D Wickramaratne, AG Dappula de Livera said the Criminal Investigations Department (CID) had informed him that two suspects in the case had left the country.

These suspects included Nishshanka Senadhipathi and Vishvajith Diaybalage, the AG said.

He added that sufficient evidence was available to prove that the eight suspects in the case had committed offences under the Firearms Ordinance and Explosives Ordinance acts.

Further, three suspects in the case could be charged for violating the Penal Code since they had provided false evidence over the case, the AG noted.

National Police Commission Secretary Saman Dissanayake, Rtd. Air Vice Marshall P.B. Premachandra and Nishshanka Senadhipathi were named as the suspects who could be charged under the Penal Code.

In addition, AG De Livera had also told the Acting Police Chief that there were no legal obstructions to arrest these suspects since the fundamental rights petitions filed by these individuals against their arrest had been dismissed by the Supreme Court and the Galle Magistrates Court on previous occasions.

Accordingly, the AG had instructed the Acting IGP to charge these suspects under the Criminal Procedure Code, and produce them before the appropriate Magistrate’s courts.

He had also called for a progress report in this regard on July 8.

Copies of the letter to Acting Police Chief Wickramaratna had also been sent to the Senior DIG and the Director of the Criminal Investigations Department (CID).

The eight suspects as named by the AG are as follows:

  • Retired Major General Palitha Fernando
  • Retired Major General Karunaratne Egodawele
  • Nishshanka Senadhipathi
  • Reitred Navy Commodore Vishvajith Nandana Diyabalanage
  • Retired Air Vice Marshall P.D. Premachandra
  • Saman Dissanayake - National Police Commission Secretary and Former Additional Defence Secretary
  • Damayanthi Jayaratne - Former Senior Additional Defence Secretary
  • Victor Samaraweera - Rakna Lanka company Chairman
