AG tells Supreme Court it has no jurisdiction to inquire into the FR petition filed against prorogation proclamation by President

The Attorney General yesterday told the Supreme Court that it had no jurisdiction to inquire into the Fundamental Rights petition filed against the Parliament prorogation proclamation by the President, as it was inconsistent with the Supreme Court rules.

The FR petition was filed as a public interest litigation by Attorney Nagananda Kodithuwakku, seeking an order against the Gazette proclamation which prorogued  Parliament sessions.

Appearing on behalf of the AG, Additional Solicitor General Indika Demuni De Silva told the court that it violated the rules of the supreme court to continue a case against an official task carried out by the President. He added that the objections will be submitted to the SC in writing in the future.

The Supreme Court ordered the petitioner to present a motion before the court and obtain a date for the petition to be taken up.
