The fundamental rights petition put forward seeking an order preventing the arrest of Makandure Madush by Sri Lankan authorities has been dismissed by the Supreme Court.
The fundamental rights petition bearing No. SC / FR 69/19 , was filed by drug kingpin Madush's Aunt - A. W Sriyani, was taken up in front of a three-member Supreme Court bench today (March 27).
The three judge bench comprised Justices Prasanna Jayawardena, Priyantha Jayawardena and S. Thurairajah, while Senior State Counsel Madawa Tennakoon represented the respondents.
Attorney Mr. Wijesurendra argued on behalf of the petitioner, claiming that Makandure Madush had not stood trial in Sri Lanka and been found guilty of a criminal case and that he was arrested in Dubai only on suspicion of using cocaine.
Further the attorney representing the petitoners said that as there is no existent extradition treaty between the government of Sri Lanka and the United Arab Emirates on this basis they were requesting court to issue and order preventing his arrest.
