The writ appeal filed by former Defence Secretary Gotabhaya Rajapaksa seeking an interim injunction on the Special High Court's order on the D A Rajapaksa memorial musueum case has been fixed for May 06.
The appeal petition which was expected to be heard today (Mar 26) was postponed by the Appeal Court citing many other pending cases that needed to be taken up for hearing.
Previously, the Special High Court had overturned a request made by Mr. Rajapaksa to file an appeal at the Supreme Court on the Special High Court's decision to reject the preliminary objections filed by him on February 20.
Accordingly, the accused had filed an appeal petition at the Court of Appeal challenging the Special High Court's decision to overturn his request.
The appeal petition filed by former Defence Secretary Rajapaksa was taken up before Justices Sampath Abeykoon, Sampath Wijeratne, and Champa Janaki Perera today.
The three-member judge bench of the Special High Court and the Attorney General have been named as respondents in the petition.
