The Supreme Court earlier this week denied interim relief to the petitioners of a fundamental rights case involving the suspension of the divisional council of the Chartered Institute of Management Accountants (CIMA) Sri Lanka. The suspension of the divisional council remains. According to the proceedings, the Supreme Court considered the submissions of Counsel and saw no basis to grant interim relief in the matter. The case will resume on July 10. The petitioners are the President of the CIMA Sri Lanka Divisional Council Gowri Shankar Somasunderam, Deputy President of CIMA Sri Lanka Viren Wijesinghe and Divisional Council Members Sunil Dharmaratna, Keith Bernard and Dinesh Weerakkody.
In the fundamental rights petition filed in February 2009, the petitioners asked the relevant state functionaries to make adequate provisions, through regulations and/or rules, to safeguard the divisional council and CIMA members from undue intervention and interferences pertaining to the governance, control and local functions of foreign institutions and/or branches of foreign institutions providing education services in Sri Lanka. Interim relief was sought in this context.
The case was heard before Chief Justice Sarath N. Silva and Justices J.Amaratunga and K. Sripavan. Sanjeewa Jayawardane with Rajeev Amarasekera appeared for the petitioners instructed by G.G. Arulpragasam. Deputy Solicitor General Sanjaya Rasaratnam apeared for the respondents.
