UPDATE: No report on implementing death penalty received so far ; Prisons chief tells court

Update: The Prisons Commissioner General today (Jun 28) informed court that he has not received any report concerning the implementation of the death penalty.

He had made these remarks when a petition filed seeking an interim order to be issued on the death penalty was taken up before the Appeal Court this afternoon.

During today's hearing, Prisons Commissioner T.M.J.W. Thennakoon said that the death penalty will not be carried out during the upcoming week.

Malinda Senaviratne, the petitioner, challenged the President's remarks stating that the death penalty would be implemented. He argued that the implementation of this punishment would be a serious violation of human rights.

However, Deputy Solicitor General Nerin Pulle appearing for the Attorney General countered the argument by pointing out that the President's decision could not be challenged under Section 34 of the constitution.

He also told court that he would be filing preliminary objections against the petition in future.

The Attorney General, Prisons Commissioner General and the Welika Prisons Superintendent have been named as respondents to the petition. The petition has been fixed for hearing on July 2.


Petition filed seeking interim order be issued against death penalty

A petition has been filed at the Appeal Court seeking to issue an interim order on the implementation of the death penalty.

The Prisons Commissioner General and the Welika Prisons Superintendent have been named as respondents to the petition.

Malinda Senaviratne, the petitioner had argued that the implementation of this punishment would be a serious violation of human rights.

He had sought an interim order to be issued on the respondents in order to prevent the punishment from being implemented.

During today's court sitting, the Prisons Commissioner General had told court that the death penalty would not be carried out during the upcoming week. The petition has been fixed for hearing on July 2.
