The Supreme Court today (Jul 5) announced that the fundamental rights petition filed against certain clauses of the Emergency Regulation would be taken up for consideration on October 8.
Gamini Viyangoda, Convenor of the Purawesi Balaya Movement and Dr. Paikiasothy Saravanamuttu, Executive Director, Centre for Policy Alternatives (CPA) had filed the petition at the Supreme Court.
The petitioners argued that Sections 19 and 58 of the Emergency Regulations as declared by the President was a violation of fundamental rights.
They pointed out that persons could be arrested under Section 19 of the Emergency Law without obtaining permission of the Defence Secretary while also limiting the powers of the judiciary on these arrests.
Attorney General Dappula de Livera and Defence Secretary Shantha Kottegoda were named among the respondents to the petition.
