The case against former Defence Secretary Gotabhaya Rajapaksa and seven others over the miuse of state funds was taken up before the Special High Court today (Jan 31).
The suspects have been accused of misappropriating funds worth Rs 33.9 million in the construction of the D.A Rajapaksa memorial museum.
During today's hearing the Attorney General had filed counter objections to the preliminary objections of the accused party which claimed that the Special High Court could not hear the case.
Accordingly, Assistant Solicitor General Dileep Peiris appearing on behalf of the Attorney General had stated that the Special High Court was established under the Judicature Act. He also pointed out that the amendment of the act which saw the inclusion of this court was done with the approval of the Supreme Court.
Further, he had also said that the case was not filed by the Attorney General according to his own wish and was instead done with the consultation of the Justices.
Therefore, Mr. Peiris had claimed that there is no objection on this court to continue hearing the case since the accused had already acknowledged the Special High Court by accepted their travel bans which were imposed by the same.
