An appeal petition filed by former Minister Basil Rajapaksa challenging an ongoing misappropriation case against him was rejected by the Appeal Court today (Sept 27).
Rajapaksa has been accused of misappropriating Rs 29 million worth funds of the Divineguma Department and is facing a trial before High Court Judge Gihan Kulatunga.
The accused had argued that a fair hearing could not be carried out since judge Kulatunga had been a member of a Presidential Commission which investigated against him.
However, the Appeal Court today held that sufficient submissions had not been made to justify the request to move the case to another court.
