Hearings of the 12 FR petitions that were filed against the President's gazette to dissolve Parliament will resume before the Supreme Court at 10 am today (Dec 06).
Attorney General Jayantha Jayasuriya, presenting submissions yesterday argued that the President was vested with powers to dissolve Parliament using his executive powers as per Articles 33 (2) and 70 of the constitution. He further said the President had acted in line with the constitution since the gazette to dissolve Parliament had provided an opportunity to exercise popular sovereignty through a general election.
Meanwhile, President's Counsel Sanjeewa Jayawardena intervening on behalf of Prof. G.L Pieris claimed that the President had the power to dissolve Parliament according to Articles 33 (2) (c) and 62 (2) of the constitution.
