Former Defence Secretary Gotabaya Rajapaksa has filed a Writ Application in the Court of Appeal (CA) asking that the court overturn the ruling made by the Permanent High Court at Bar rejecting the preliminary objections raised by his lawyers into the misappropriation of Rs 33.9 million in state funds in the D.A. Rajapaksa memorial museum case.
On February 20, the three-judge Permanent High Court at Bar dismissed an appeal made by Mr Rajapaksa’s lawyers asking that the court grant permission for them to file an appeal in the Supreme Court against the ruling given by the Permanent High Court at Bar.
Accordingly, his lawyers have filed a writ application in the CA asking that the court overturn the ruling given by the three judge bench comprising Judges Sampath Abeykoon, Sampath Wijeratne and Champa Janaki Rajaratne.
The lawyers have also asked the CA to issue a ruling preventing the Permanent High Court at Bar from hearing the case on the D.A. Rajapaksa Museum until the conclusion of the hearing into the writ application.
The writ application is to be considered by the CA on March 12.
