The Supreme Court rejected an application filed by former JVP leader Rohana Wijeweera’s wife seeking an order to direct the Government to produce her husband.
This was after a Hebeas Corpus – a writ requiring a person under arrest to be brought before a judge or into court, especially to secure the person's release unless lawful grounds are shown for their detention was turned down by the Court of Appeal earlier.
Ms Chithrangani Wijeweera had thereafter appealed to the Supreme Court seeking an order.
But, a three judge bench comprising Sisara de Abrew, S. Thurairaja, and Gamini Amarasekara to dismiss the application without hearing of the petition on the grounds that there was no legal grounds to consider the petition.
Lawyers appearing on behalf of Ms Wijeweera pleaded that the Court of Appeal position to reject the Hebeas corpus Application, on the grounds that it was submitted 30 years .later cannot be accepted.
However, the Supreme Court held that there was no valid legal grounds to take up the petition. (MG)
