The Supreme Court (SC) has determined that the Penal Code (Amendment) Bill which decriminalises homosexuality is not inconsistant with the Constitution, Speaker Mahinda Yapa Abeywardena announced in Parliament today.
Accordingly, the bill can be passed with a simple majority in Parliament and will not require a 2/3 majority or a referendum.
The bill was tabled in Parliament as a private member's bill by Sri Lanka Podujana Peramuna (SLPP) MP Premanath C. Dolawatte. It was subsequently challenged in the SC by several petitioners and the SC after concluding hearings into the petitions, sent its determination to the Speaker.
