Waruni Bogahawatte, OIC Matara Division Police, Child and Women’s Bureau was found guilty by the Supreme Court for violating the fundamental rights of a minor, this week.
Ms. Bogahawatte, who is known for arresting child abusers was found guilty of violating the rights of a 10-year old girl by unlawfully detaining and threatening her with an ulterior motive of framing a politician.
According to the court proceedings she had attempted to forcefully obtain details of an alleged relationship which the victim had repeatedly denied having with the politician.
Documents submitted by the petitioner show that Ms. Bogahawatte had threatened and locked her up at the police station with another suspect without food and water.
Issuing the verdict, a three-member Supreme Court judge bench ruled that the accused had violated the rights of the child under four counts by unlawfully arresting and detaining the victim.
Accordingly, court ordered OIC Bogahawatte to pay a compensation of Rs 100,000 to the child within a period of one year. The government too was instructed to pay a compensation of Rs 50,000 to the child as compensation.
The case was heard before Justices Buwaneka Aluwihare, Priyantha Jayawardena and Vijith K. Malalgoda.
