The petition filed against the non-granting of a contract to Lakdanavi Limited for the construction of the second phase of the 300 MW Kerawalapitiya Power Plant was taken up before the Supreme Courts yesterday (Apr 05).
Deputy Solicitor General Milinda Gunathilaka who appeared on behalf of the Attorney General informed court that cabinet had approved the awarding of the tender to China-based GSL company on April 02.
However, the attorney representing the Public Utilities Commission (PUC) argued that the PUC should have been informed regarding the proposal to award the tender to GSL before being submitted to the cabinet.
In response, the Deputy Solicitor General while holding that the cabinet decision was correct, told court that the PUC would be officially informed of this decision in the near future.
The attorney for the PUC however objected to this statement by reiterating that the PUC must be informed regarding these decisions prior to being put for cabinet approval and not afterwards.
After having considered the arguments put forward by both parties, the Supreme Court ordered that the case will be taken up for further hearing on May 20.
