The Court of Appeal was informed by the counsel for the respondents that he had not been able to obtain the signatures of the IGP and the OIC of the Atchuvely Police Station to file their objections and as such moved for time.
The habeas corpus petition was filed by Murugananda Janatha, wife of Kitnam uruganandan(Kugan)and Arumugam Weerarajah, father of Lalith Kumara both allegedly abducted and cited Jaffna Army Commander Maj. Gen. Mahinda Hathurasinghe, Army Commander Lt. Gen Jagath Jaysuriya, OIC Atchuvely Police Station, IGP N.K. Illangakoon and the Attorney General as respondents.
The two persons were members of an organization called Jana Aragala Viyaparaya, a movement calling for peace and harmony among all citizens of Sri Lanka. They were on there way to Jaffna on December 12, 2011 to organize a meeting of the group. The petitioners said that since the two had not returned they informed the Police.
Subsequently the motor cycle that they were using for travel was found abandoned by the wayside.
The petitioners stated that on a previous occasion Kugan’s mother had received an anonymous call threatening her saying ‘if you don’t take your son away we will do it for you’.
The 1st and 2nd respondents deny all allegations while the 3rd and 4th respondents were allowed to submit their submissions on the previous occasion when the case was called.
The Appeal Court also directed the Jaffna Chief Magistrate to conduct an inquiry and report to the Appeal Court
In view of the request made by the respondents the case was postponed to May 14. |
