The Supreme Court on Thursday terminated the proceedings of the fundamental rights petition filed by public interest activist Vasudeva Nanayakkara against John Keells Holdings (JKH) and Lanka Marine Services (LMS) on the 'illegal' tax concessions the company received from the Board of Investment (BOI) since relief has been already provided to the petitioner.
Such relief was given in the July 21 judgment by the court overturning the privatisation. In that order BOI concessions were ordered to be revoked and LMS instructed to pay taxes in the amount of Rs.375 million based on formal assessments by the Inland Revenue Department.
The 3-judge bench headed by Justice N.G. Amaratunge allowed the plea made by Counsel Viran Corea appearing for the petitioner to withdraw the petition as the relief had already been granted. Romesh de Silva, counsel who appeared for the respondent JKH and LMS agreed to the request, in court.
