Bar council opposes probe on retired CJ

The Bar Council of the Bar Association of Sri Lanka (BASL) yesterday passed unanimously a resolution urging the government to refrain from appointing a Parliamentary Select Committee to inquire into the conduct of a retired Supreme Court Judge as it violated the Constitution.

The move comes in the backdrop of government moves to subject retired Chief Justice and government critic Sarath Nanda Silva to scrutiny by a parliamentary committee. The resolution moved by Tirantha Walaliyadde PC, a candidate for the forthcoming BASL Presidential elections and seconded by Nimal Weerakkody did not name any person but said that the Bar Council was not condoning the conduct referred to in the allegations made in the contemplated inquiry but its interest was "solely in the interests of the Rule of Law and for the purpose of safeguarding the independence, impartiality and the integrity of the judiciary".

The resolution disapproving government moves, pointed out that the Constitution only provided for inquiries in respect of sitting judges under certain procedures and not to retired judges.
